1. Introduction
These Terms of Service govern the purchase and use of all products supplied by Nutrivision including, but not limited to, silicone food molds, plate covers, and printed or digital cookbooks. By purchasing or using our products, you agree to be bound by these Terms.
2. Intended Use
Our products are designed for use in food preparation, presentation, and education within healthcare, aged care, and related environments. They are intended to be used only in accordance with provided instructions, industry standards, and applicable food safety and care guidelines, including IDDSI where relevant.
3. User Responsibility
The purchaser and end user are solely responsible for:

Assessing the suitability of products for their specific application

Ensuring correct use, handling, cleaning, and storage

Ensuring food prepared using our products meets the dietary, texture, allergy, and clinical requirements of the individual being served
Products must only be used by trained or informed personnel where clinical or care decisions are involved.
4. No Medical or Clinical Advice
Any information provided in our cookbooks, documentation, marketing materials, or verbal communications is for general informational purposes only. It does not constitute medical, nutritional, or clinical advice and must not replace professional judgment, assessment, or prescribed care plans.
5. Limitation of Liability
To the fullest extent permitted by law, Nutrivision shall not be liable for any loss, damage, injury, illness, or death arising from:

Misuse, improper use, or use outside intended purposes

Failure to follow instructions, guidelines, or recognised care standards

Incorrect food preparation, texture modification, portioning, or serving

Use of products in clinical decisions without appropriate professional oversight
This limitation applies whether harm is direct or indirect and whether arising from negligence, misuse, or misunderstanding of product application.
6. Assumption of Risk
By using our products, the user acknowledges that food preparation and service in healthcare settings carries inherent risks. The user assumes full responsibility for managing these risks, including ensuring compliance with relevant food safety, swallowing safety, and care standards.
7. Warranties
Our products are provided with guarantees required under Australian Consumer Law. Except as expressly required by law, no additional warranties are provided, whether express or implied.
8. Returns and Refunds
Returns and refunds are subject to our Returns Policy, available on our website or upon request. Custom-made or personalised products may not be eligible for return.
9. Intellectual Property
All content, designs, molds, images, and written materials produced by Nutrivision remain our intellectual property and may not be copied, reproduced, or distributed without written permission.
10. Governing Law
These Terms of Service are governed by the laws of Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of Australian courts.
11. Amendments
We reserve the right to amend these Terms of Service at any time. Continued use of our products constitutes acceptance of the most current version.
